Health & Fitness to Participate

BON CHARGE events may include physical activity (such as running, pilates, strength, or movement classes) and/or use of BON CHARGE wellness devices, including red and near-infrared light therapy devices. Some activities and devices are not suitable for everyone.

By signing this form you confirm that:

  • Your participation is voluntary and you understand that physical activity carries inherent risks, including muscle strain, sprains, falls, dehydration, cardiovascular events and other injury.
  • You are physically and mentally fit to take part and you are not aware of any condition, injury, allergy, pregnancy or medication that would make participation unsafe.
  • You will inform the event team before you start of any condition, injury, allergy, pregnancy or medication that may affect your ability to take part safely, and you will stop and notify staff immediately if you feel unwell or experience pain or discomfort.
  • You will follow all instructions from instructors and staff, will use any equipment only as directed, and will wear appropriate clothing and footwear.
  • You authorise event staff to administer basic first aid and to call for emergency medical assistance if reasonably required, and you accept that you are responsible for any related medical costs.

Red light and near-infrared light devices.

If your event includes red or near-infrared light therapy or any other BON CHARGE device, you also confirm that:

  • You understand the device is intended for general wellness only. It is not a medical treatment, diagnosis, or substitute for professional medical advice.
  • You will follow distance, exposure-time and positioning instructions, will wear any protective eyewear provided, and will not stare directly into the light source.
  • You understand the device may not be suitable for people who are photosensitive or taking photosensitising medication, pregnant or trying to conceive, undergoing cancer treatment, managing uncontrolled epilepsy or seizure disorders, recovering from recent surgery or with open wounds in the treatment area, have metal implants or pacemakers, or have eye conditions that require specialist guidance.
  • If any of the above applies to you, you confirm you have obtained medical clearance to participate.
Voluntary Participation, Risk & Liability

To the maximum extent permitted by law, you release and hold harmless BON CHARGE, its parent and group companies, directors, officers, employees, instructors, contractors, venue providers and equipment suppliers (the "Released Parties") from any and all claims for loss, damage or injury (including death) arising from or connected to your participation in the event, except to the extent caused by the gross negligence or wilful misconduct of a Released Party.

You agree to indemnify the Released Parties against any loss they suffer as a result of your breach of this agreement or your wilful or negligent acts or omissions.

Your statutory rights are not affected.

Nothing in this form excludes or limits any right you have that cannot be excluded under applicable law, including, but not limited to:

  • in the United Kingdom, your rights under the Unfair Contract Terms Act 1977 and the Consumer Rights Act 2015 (which prevent us from excluding liability for death or personal injury caused by negligence, or for fraud);
  • in the European Union, mandatory consumer protection law in the country of the event;
  • in the United States, any non-waivable rights under the law of the state where the event takes place (some states do not enforce pre-injury liability waivers); and
  • in Australia, the consumer guarantees and other non-excludable rights under the Australian Consumer Law.
Photography & Filming

Photography and video may be captured at this event. Identifiable footage of attendees may be used by BON CHARGE for marketing on social media, our website, in email and in paid advertising, and may be shared with our event partners and contracted media agencies for those purposes. Tick the box below only if you agree.

You can withdraw your consent at any time by emailing hello@boncharge.com or by speaking to a staff member. Withdrawal will not affect any use that has already taken place. If you do not want your image captured, please ask a staff member at check-in for an opt-out marker; we will use reasonable efforts to avoid identifiable footage of you, but cannot guarantee removal from incidental wide or crowd shots.

Marketing — optional

You can take part in this event without signing up for marketing. Tick a box only for the channels you would like to hear from us on. These boxes are not pre-ticked and are independent from the rest of the form.

You can unsubscribe at any time using the link in any email, by replying STOP to any SMS, or by emailing hello@boncharge.com. Withdrawing consent will not affect the lawfulness of any processing carried out before withdrawal.

How We Use Your Personal Information

The data controller for the personal information collected on this form is Blublox Pty Ltd, trading as BON CHARGE Pty Ltd (ACN 625 643 272).

We use your information to register you for the event, to keep you safe during it, and to respond in an emergency. Our lawful bases are the performance of our agreement with you, our legitimate interests in running a safe event, and (in an emergency) protecting your or another person's vital interests. Where you tick the optional boxes above, we also use your information for photography and marketing on the basis of your consent, which you can withdraw at any time.

You have the right to access, correct, delete, restrict or port your data, to object to processing and, where the processing is based on consent, to withdraw consent at any time. If you are in the EU, UK or California you also have the right to lodge a complaint with your supervisory authority — in the UK, the Information Commissioner's Office (ico.org.uk); in the EU, your national data protection authority; in California, the California Privacy Protection Agency. Australian residents may complain to the Office of the Australian Information Commissioner (oaic.gov.au).
